1. Scope<\/strong>
These general terms and conditions apply to all contracts between the law firm Legal-DPT (hereinafter \"Kanzlei\") and its client, unless expressly agreed otherwise in writing or imperative legal regulations are contrary. Deviating conditions of the client do not apply unless they are expressly recognized in writing.<\/p>

2. Subject of the mandate<\/strong>
The subject of the mandate is the legal activity of the law firm. A certain legal or economic success is not owed. The law firm provides its services in accordance with the principles of proper professional practice and in compliance with the applicable professional and legal regulations.<\/p>

3. Client's obligations to cooperate<\/strong>
The client is obliged to inform the law firm completely and truthfully about all circumstances relevant to the processing of the mandate. All required documents must be made available in good time and in full.<\/p>

During the term of the mandate, the client must immediately notify changes to his contact details, in particular the address, telephone number and e-mail address. Disadvantages caused by late or incomplete information are at the expense of the client.<\/p>

4. Compensation<\/strong>
The law firm's remuneration is generally based on the Lawyers' Remuneration Act (RVG), unless a different remuneration agreement (e.g. hourly fee or flat-rate fee) has been expressly made in text form.<\/p>

The law firm is entitled to demand reasonable advances for fees and expenses that have already been incurred or expected. The processing of the mandate can be made dependent on the payment of an advance, to the extent that this is permitted by law.<\/p>

5. Liability and Limitation of Liability<\/strong>
In the event of a simply negligent breach of duty, the law firm's liability for damage arising from the mandate is limited to the amount of the existing professional liability insurance, but at least to four times the amount of the statutory minimum insurance sum in accordance with \u00a7 51 BRAO, to the extent permitted by law.<\/p>

This limitation of liability does not apply to intent or gross negligence or injury to life, limb or health. Any further liability shall remain unaffected, provided that mandatory statutory provisions provide for this.<\/p>

6. Communication by Email<\/strong>
If the client gives an e-mail address to the law firm, he agrees that the law firm will send him mandate-related information unencrypted by e-mail.<\/p>

The client is aware that security risks exist in the case of unencrypted electronic communication and that complete confidentiality cannot be guaranteed. A secure form of communication can be agreed upon request.<\/p>

7. Copyright<\/strong>
All copyrights and usage rights, insofar as these are protected by copyright, remain with the law firm, in all documents prepared by the law firm, in particular expert opinions, drafts, briefs and concepts.<\/p>

The client receives a simple right of use within the framework of the mandate for the use of these documents for the agreed purpose. Any further use, reproduction or disclosure to third parties requires the prior written consent of the law firm.<\/p>

8. Confidentiality and Privacy<\/strong>
The law firm is obliged to maintain confidentiality about all information that has become known to it within the framework of the mandate. This obligation continues even after the end of the mandate.<\/p>

The processing of personal data takes place exclusively within the framework of the statutory data protection regulations. More information on this is included in the law firm's separate data protection declaration.<\/p>

9. Final Provisions<\/strong>
The law of the Federal Republic of Germany applies to the exclusion of the UN Sales Convention.<\/p>

To the extent permitted by law, the place of performance and jurisdiction for all disputes arising from the mandate relationship is the registered office of the law firm. This applies in particular if the client is a merchant, a legal entity under public law or a special fund under public law.<\/p>

If a provision of these General Terms and Conditions is or becomes invalid in whole or in part, the validity of the remaining provisions remains unaffected.
